When “I’m Sorry” Becomes Evidence

Ontario’s Apology Act, 2009 was enacted to ensure that individuals and organizations could say “sorry” without that expression being used as evidence of fault or liability against them. The Act defines an apology broadly, covering statements of sympathy, regret, or compassion, as well as explicit acknowledgements of responsibility and any words or conduct that convey contrition. By removing the legal risk traditionally associated with apologizing, the legislation encourages people to communicate openly and honestly after an incident.

The purpose behind the Act was to promote sincere, human interactions in the aftermath of harm by eliminating the fear that an apology could later be weaponized in court. Before the legislation, professionals and institutions were often advised not to apologize, which created distance, mistrust, and unnecessary escalation. The Act was designed to break that pattern by allowing people to express remorse without triggering legal consequences, thereby supporting early resolution, transparency, and more humane communication.

What the legislation recognizes is something instinctive: people say sorry even when they are not at fault. Canada is frequently described as one of the most polite societies in the world precisely because saying “sorry” is part of our social reflex. We apologize to defuse tension, to show empathy, and sometimes simply to bring an uncomfortable interaction to an end.

But that instinct, protected in civil law, becomes dangerous in the criminal context.

Ontario’s Apology Act applies only to civil disputes—car accidents, medical negligence claims, and similar matters. It has no application in criminal law. In a criminal case, your right to silence is paramount. That right does not only apply to police questioning; it extends to interactions with anyone who is accusing you of wrongdoing.

This is where people get into serious trouble. In many sexual assault cases, complainants will reach out by text, email, or voice message in the days following an incident. The purpose is often not reconciliation—it is to elicit a response that can later be given to the police. Faced with an accusation, it is entirely human to respond with sympathy, confusion, or a desire to calm the situation. People think that if they do not placate the accuser, the situation will escalate. So they say something—anything—to make it go away.

That instinct can be fatal to a defence.

An apology, or even an ambiguous statement such as “I’m sorry you feel that way,” can be interpreted as an admission. Once reduced to writing or recorded, it becomes powerful evidence. Stripped of context, tone, and the emotional pressure in which it was made, it can be presented as consciousness of guilt.

The hard truth is this: what protects you in a civil lawsuit will not protect you in a criminal prosecution. The safest course—often the only safe course—is to say nothing at all. Do not explain. Do not justify. Do not apologize.

Silence, in this context, is not indifference. It is self-preservation.
